What is Reckless Homicide?

A person commits Reckless Homicide when a person drives a motor vehicle and unintentionally kills an individual without lawful justification.  A common example of Reckless Homicide is when a person commits DUI, which causes the death of another individual.

What if I am not under the influence of alcohol or drugs, but I still have cannabis or other drugs in my system?

As the law currently stands, if you have any amount of drugs in your system, including cannabis, and you are involved in a motor vehicle accident that causes the death of another individual, you can be charged with Reckless Homicide.
Reckless Homicide is generally a Class 3 Felony.
Reckless Homicide contains further complexities such as the number of people killed in the accident, whether the accident occurred near a school zone, as well as several other complexities.
