If you are charged with a Violation of an Order of Protection, it is vital to hire an experienced Criminal Defense Attorney.
The attorneys at Pechter & Pechter LLP have experience defending those who have been charged with a Violation of an Order of Protection and will not only aggressively fight your case, but will explain your options and assist you in making an informed decision.

What is a Violation of an Order of Protection?

A person commits a Violation of an Order of Protection if he or she knowingly does an act which was prohibited by a court or fails to perform an act which was ordered by a court in violation of a valid Order of Protection.
A Violation of an Order of Protections occurs only after the offender has been served notice of the contents of the Order of Protection
The Order of Protection may have been issued in either a Criminal or Civil proceeding

Is a Violation of an Order of Protection a crime even if the Order of Protection was issued in Civil Court?

Yes, regardless of whether the Order of Protection was issued in a Criminal or Civil Court, a Violation of an Order of Protection is a crime.
Generally, a Violation of an Order of Protection is a Class A Misdemeanor. However,  a Violation of an  Order of Protection may be a Class 4 Felony if the Defendant has any prior convictions for Domestic Battery, Violation of an Order of Protection, or various other crimes.
Be sure to talk to an experienced Criminal Defense Attorney if you are issued an order of protection to (1) make sure you understand all the conditions set forth, and (2) whether you wish to fight the Order of Protection itself.
See our Felonies and Misdemeanors page to learn more about Class A misdemeanors and Class 4 Felonies.
